1. Scope
The provider of Spicky is Arc Rider Ventures GmbH, Jänickendorferstr. 64A, 14943 Luckenwalde, Germany (“we”, “Spicky”). These terms of use apply to all users of the Spicky app and website.
2. Description of the service
Spicky is a digital “cheat sheet” for movies and shows. Users can create watchlists (“cheat sheets”), save titles, add ratings and notes, share lists with friends, connect with friends, send invites, post comments on titles and lists, and receive recommendations.
3. Contract, free use
The contract is concluded upon successful registration of an account. Use of Spicky is currently free of charge. We reserve the right to introduce paid features in the future; such features will be clearly marked before use.
4. Registration and account
- You must be at least 16 years old to use Spicky.
- The information provided on registration must be truthful.
- Login credentials must be kept confidential and must not be shared.
- Each person may generally only create one account.
5. User obligations
When using Spicky, in particular, the following is prohibited:
- posting unlawful, insulting, discriminatory, glorifying violence or youth-endangering content,
- infringing third-party rights (especially copyright, trademark or personality rights),
- burdening the service through automated queries, scraping or similar means,
- harassing, deceiving or unwantedly contacting other users,
- circumventing security measures or using the service contrary to its purpose.
You can report other users’ content (e.g. comments, list names) at any time by email to hello@spicky.de. We review reports promptly and remove infringing content. You can also block other users directly in the app so that neither of you sees the other’s content anymore.
6. Your content and licence
You retain all rights to content you submit (e.g. notes, ratings, list names, comments). You grant Spicky a non-exclusive, worldwide, perpetual licence to store, display and — to the extent you actively enable it (e.g. shared lists) — make this content available to other users, solely for operating and providing the service.
6a. Moderation and zero tolerance for abuse
We have zero tolerance for abusive, harassing or unlawful content. For substantiated reports we typically remove the affected content within 24 hours and may warn, suspend or delete accounts. You can block other users in the app at any time; blocked users no longer see your comments or shared lists and vice versa, and any existing friendship is automatically ended.
7. Third-party movie and show content
Movie and TV metadata (titles, covers, descriptions, cast etc.) is sourced via the Open Movie Database (OMDb) and possibly other third-party sources. All trademark and image rights remain with their respective rights holders. Spicky provides this content for informational purposes only.
8. Availability
We strive for the highest possible availability of Spicky but do not owe any specific uptime. Maintenance work, technical disruptions or adjustments may lead to temporary restrictions.
9. Termination and account deletion
You can delete your account at any time without giving reasons via the app settings. We may terminate the user agreement with reasonable notice and may suspend or delete accounts in the event of serious breaches of these terms.
10. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for the breach of essential contractual obligations (cardinal obligations) and limited in amount to the foreseeable damage typical of the contract. Liability under the German Product Liability Act remains unaffected.
11. Changes to these terms
We may amend these terms of use for legitimate reasons (e.g. changes in the legal situation, technical developments). We will inform you of changes with reasonable notice by email or in the app. If you do not object within the period communicated, the amended terms will be deemed accepted.
12. Governing law, jurisdiction
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected. The place of jurisdiction for merchants is Potsdam.
